Per the Commonwealth of Virginia, some of our powers and duties as guardians include:
• Our senior care firm needs court approval ahead of time:
• to make admit an incapacitated person into a long term care setting
• to end or consent to the an incapacitated adults plan medical plan of care
• to change the person's marital status
• As guardian, we should encourage the person to participate in decisions, to act on his or her own behalf, and to develop or regain the ability to manage personal affairs. In making decisions, our senior care firm needs to consider the person’s expressed desires and personal values to the extent we can determine them. If we cannot determine those desires and values, we must act in the person's best interest and exercise our fiduciary duties with care, diligence, and prudence.
• We have the authority to arrange for the funeral and disposition of remains, including cremation, interment, entombment, inurnment, or scattering of the ashes. Our senior care firm should make a good faith effort to locate the person’s next of kin to make such arrangements. Good faith effort means contacting the next of kin listed in the guardianship petition. We cannot be held liable for the decisions we make regarding the body disposition unless you acted in bad faith or malicious intent.
